The Supreme Courtroom on Monday held that states are empowered to make particular provisions for granting quota in admissions in PG programs to authorities docs serving in distant areas.
A five-judge structure bench headed by Justice Arun Mishra held that states have legislative competence to make particular provisions for reservation.
The highest court docket mentioned that the Medical Council of India (MCI) regulation that barred such reservation is bigoted and unconstitutional.
The bench mentioned that the MCI is a statutory physique and has no energy to make provisions for reservations.
The judgement was pronounced on a plea by Tamil Nadu Medical Officers Affiliation and others contending that giving reservation advantages would encourage these working in authorities hospitals and in rural areas.
