The Supreme Courtroom has acquitted a person in a 20-year-old rape case observing that he and the alleged sufferer had been in love, their relationship was consensual and the case was “an afterthought” – filed when the person was about to marry one other lady.
The bench of Justices RF Nariman, Navin Sinha and Indira Banerjee put aside the conviction by a trial court docket and the Jharkhand Excessive Courtroom quoting medical consultants, who established that the girl was 25 years previous when she filed the case in 1999, and never 20 as she claimed, making her a significant on the time of the alleged assault in 1995.
The court docket added that letters exchanged between the 2 and their pictures collectively confirmed they had been in love and case of rape and dishonest on pretext of marriage was filed per week forward of the person’s marriage ceremony to a different lady.
It added that no lady, after being sexually assaulted at knife-point, would write love letters to the accused and share a live-in relationship with him for 4 years.
The girl had claimed she stayed fairly after the assault as a result of the accused has promised to marry her.
“The wedding between them couldn’t materialize resulting from societal causes as the person belongs to a Scheduled Tribe, whereas the girl is a Christian… The girl had deposed that their marriage couldn’t be solemnized as a result of they belonged to completely different religions. She was due to this fact aware of this impediment all alongside…” the court docket stated.
The court docket added it was not attainable to carry, on the premise of proof, that the person by no means meant to marry her and quoted the girl’s letters by which she had acknowledged that the person’s household at all times handled her properly, and that their households even obtained them engaged.
